Terms & Conditions
Updated 3 November 2026 · Draft for operator and professional review before paid launch
Nelly's Hart is a trading brand. Legal operator details are awaiting confirmation; paid launch is not approved. Contact: info@nellyshart.co.uk.
Who you contract with
Nelly's Hart is a trading brand, not assumed to be a registered company. The confirmed legal operator shown above is the contracting party. Operator identity, address and applicable company/VAT numbers must be supplied before paid launch. Contact info@nellyshart.co.uk for support or complaints.
Parent accounts and free creation
Accounts and purchases are for parents or guardians responsible for the content. Keep credentials and authenticator access private and report misuse promptly. Creating and previewing in the Studio is free. Children may create with adult supervision; they must not make purchases independently. Do not bypass security, impersonate another person or access another family's files.
Digital products and delivery
A single design PDF costs £5.99; a complete 32-interior-page memory book PDF costs £12.99. Prices include VAT where applicable; printing and delivery are not included. Payment is a one-off purchase, not a subscription. Supply follows verified payment, not the redirect alone. The PDF is generated in a supported modern browser from your saved book; first generation may require the device on which the book was made. You need internet access for checkout and cloud access, sufficient device space and a PDF reader. Save a copy; source-photo expiry can prevent later first-time generation.
Cancellation and statutory remedies
UK consumers normally have a 14-day cancellation period for distance purchases. Immediate digital supply requires separate express consent and acknowledgement that the cancellation right is lost once supply begins; statutory remedies for faulty, misdescribed or non-conforming content remain. See Digital Downloads & Refund Policy for the request process. We do not declare every purchase non-refundable. Durable contract confirmation must be supplied and verified before paid launch.
Intellectual property
Nelly's Hart owns or licenses its branding, website design, software, templates and original platform content. Parents retain ownership of their uploaded photographs and original artwork, subject to others' rights. Uploading grants only the limited permissions needed to host, process, export and fulfil requested purchases, including necessary service providers. It does not transfer ownership or grant marketing or AI-training rights. Purchased digital designs are for personal use subject to third-party rights; platform templates and branding may not be resold or represented as your own platform.
Uploads and safeguarding
Upload only material you are entitled to use and share with the necessary service providers. Do not upload unlawful, exploitative, abusive or discriminatory content, others' confidential information, malware or content infringing intellectual property or privacy rights. Children's content must not be used for marketing or AI training without an appropriate lawful basis and any necessary separate consent. Avoid unnecessary sensitive details; the Privacy Policy describes data handling and limits.
Physical purchases through Etsy
Physical products, printing and delivery are separate contracts through the relevant Etsy seller, under that seller's lawful terms. A book reference is used for manual matching; clicking an Etsy link does not buy anything. Personalised goods may fall within a change-of-mind cancellation exception, but rights for faulty or misdescribed goods remain. The seller's identity and contractual responsibilities must be clear in the Etsy listing. Hardcover physical sample approval is outstanding.
Availability, suspension and liability
We aim to operate reliably but maintenance, device limitations or outages can affect access. Do not rely on the service as the only copy of important memories. Accounts may be restricted for serious misuse or security risk, with notice where practicable and proportionate handling of paid purchases and data rights. Nothing excludes liability that cannot lawfully be excluded, including fraud, death or personal injury caused by negligence, or mandatory consumer rights. Any further limitation must be fair and professionally reviewed; no blanket exclusion is imposed here.
Complaints, law and changes
Email your reference and a description of the issue; do not send passwords or children's photographs. We will investigate and explain the proposed remedy. The operator must confirm establishment and appropriate governing-law wording; mandatory UK consumer protections and any right to bring proceedings in your home jurisdiction are preserved. Material changes apply prospectively with appropriate notice and cannot retrospectively remove rights attached to a purchase.
